- Writing is the skilland the pain point. Even students who understand the rule struggle to write like someone who’s not negotiating a hostage exchange with grammar.
Generative AI can help with both. It can also manufacture fake cases, flatten nuance, and deliver confident nonsense in a tone that sounds like it’s wearing a suit. That’s why business law teaching can’t ignore AIit has to shape it.
The Big Shift: From “AI Police” to “AI Coach”
Early on, my instinct was to ban AI use on written assessments. But online courses make bans hard to enforce, and the more I tried to “catch” misuse, the more I realized I was building a compliance regime instead of a learning experience. - Final Draft (Track Changes On): Students revise into a polished memo, showing edits so I can assess legal accuracy, writing improvements, and how well they used AI as a drafting assistant rather than a ghostwriter.
This approach does three important things at once: it forces a “human baseline,” it rewards transparent process, and it teaches students that AI output is not authority. It’s input.
The Sustainable Upgrade: When the Process Became Too Big to Grade
A hard truth about thoughtful writing assignments: they generate a lot of grading. When you have a large enrollment, a beautifully designed multi-stage workflow can turn into a personal endurance sport.
The fix wasn’t abandoning the learning goalsit was changing the logistics. Instead of requiring every student to create the first draft, I started providing it. I write an intentionally flawed draft (which, as a lawyer, feels like writing with oven mitts). Business law students need reps. Lots of reps. AI can generate variations of fact patternsnew industries, new players, new complicationsso students aren’t memorizing one scenario and calling it “mastery.” You can ask for: a contract dispute with ambiguous acceptance, a product liability scenario with a distributor twist, or a startup employment issue involving misclassification and confidentiality obligations.
The key: you still control the doctrine and the learning objective. AI supplies volume and variety; you supply standards.

Courts have sanctioned lawyers for filing materials containing fabricated case citations and misrepresented authority. If students leave your course thinking AI is a magic legal printer, they’re walking into a buzzsaw.
In class, I treat AI output like a junior associate who’s confident, fast, and occasionally wrong in ways that could set your office on fire. You don’t yell at the junior associate; you train them and verify their work. Same with AI.
Confidentiality and Privacy: Don’t Upload What You Can’t Unshare
Even in a student setting, we can model best practices: avoid entering sensitive personal data, confidential business facts, or anything that would be inappropriate in a professional client relationship. This becomes a natural entry point into broader governance frameworks that stress risk management, transparency, and accountability in AI use.
Bias and Fairness: AI Can Mirror the Mess We’re Trying to Fix
Legal systems already struggle with bias. AI can amplify itthrough uneven training data, biased framing, or “default” assumptions baked into outputs.
